Nucla man sentenced in child porn case nets probation sentence

NUCLA - A Nucla man charged with sending child pornography by computer to an undercover officer in Ohio has pleaded guilty to a single misdemeanor count of sexual exploitation of children.

Thomas Scott Barnes, 36, entered the plea Tuesday in Montrose County Associate Court in Nucla.

In exchange for the plea, prosecutors dropped 17 additional counts.

Judge Bette Nickell sentenced Barnes to two years of probation and 192 hours of useful public service.

He also must register as a sex offender and pay $1,571 in fines and court costs.

In January, Det. Mark A. Baumgardner of the Perrysburg (Ohio) Police Department made contact with Barnes while working undercover through an America Online chatroom looking for sexual predators willing to exchange child pornography, Montrose County Sheriff's Office Investigator Bill Smith has said.

Baumgardner posted a message in the chatroom, which Barnes reportedly answered by sending the detective about seven pornographic photographs depicting females under 18.

Police believe Barnes randomly obtained the pictures from the Internet, Smith has said.

Baumgardner subpoenaed AOL to obtain Barnes's identity. MCSO personnel searched Barnes' residence in February and seized his computer.

No hard copy of child pornography was found at the residence.
