Election or appointment necessary to fill mayor’s seat

MONTROSE — The Olathe Board of Trustees has two options in response to Olathe Mayor Don Perkins’ resignation.

The board may either fill the vacancy via an appointment or an election, said town attorney David Masters.

“The town must do one of the two things within 60 days,” Masters said. If the board fails to make a decision within 60 days, it defaults to an election that must take place as soon as practicable.

Since Olathe is a statutory town, power is vested in the board of trustees, which consists of one mayor and six trustees.

If the board of trustees chooses to appoint someone who is already on the board to fill the mayor’s position, it must then appoint someone else to fill the vacant board seat. Seven people must be on the board.
