Losing access: Residents concerned over driveway removals

MONTROSE  — When Montrose renter Christine Allen arrived home from work last week, she was surprised to see her driveway gone and a steep curb blocking any access.

Around Allen’s home at 601 N. Second St., the city is reconfiguring several drainage systems. Crews are removing metal drainage culverts that run parallel to Park Avenue between North First and North Third streets, replacing them with concrete valley pans. Curb, gutter and sidewalk construction is also part of the project.

Allen and her neighbors were made aware of the construction plans. However, some citizens did not realize that construction meant the loss of access to their garages from the street.

City staff removed Barrett Beshoar's driveway to his garage at 548 N. Second St. and are planning to expand the curb to the alleyway. The city said they would put a "drivable surface" so Beshoar's could access the garage from the alley. (Joel Blocker / Daily Press)

“I can’t park where my driveway was,” said Bogdan Bugalski, who’s owned his home at 200 N. Park Ave. for about 27 years.

Until last week, Bogdan and his wife, Bozena, who are both retired and on disability, were able to pull into their driveway off of Park Avenue, and park their two vehicles right in front of their garage. This enabled them to walk through their gate and into their home.

Now, the driveway is gone and a tall curb blocks any access from the street. Bogdan is using the alley, but because of a utility pole — which he has no right to move because it’s inches outside his property — he has to park perpendicular to his garage, barely fitting one vehicle.

Removing driveways is primarily a safety issue, city spokesperson David Spear said. Vehicles backing out onto a major arterial roadway, like Park, are dangerous. Using alleyway access or parking on the street is safer.

    " I am sure I am speeking for alot of people when I say this is wrong! The city government is out of control and rather than get lawyers involved get people together and stand up for yourselves. Go to the city council. Get the city government cleaned up. I'd like to see if one of their homes and property values were being effected how far this would go! "

    The City may have the right to do it, and probably will get their way in the end. However, I think the point is the direction that the current administration is taking is out of touch, indifferent to the citizens of Montrose, and pretty much arrogant. Of course, they will defend their actions, but the actions speak much louder than words. "

And as must as people are complaining, the fact is, the city had the right to do it. So the city would just spend money (tax money) to defend what they had the right to do.     " Admittedly, I don’t know all the details. However, on the surface it appears that the City of Montrose has removed pre-existing, historic access to a number of private properties. As a result of recent construction the City is effectively denying historic access to those private owners. I would recommend that the affected owners seek an out of county attorney and pursue a law suit to restore access to the properties, recover damages and be compensated for all attorney’s fees and court costs. "

I think this is a case of "What's done is done what you going to do about it?" These properties were built with building permits and driveway access permits that were granted.     " Nobody is willing to be inconvenienced for a week or so for the bigger picture. Oh yeah, I forgot, it is just so much easier to cause a stink and get people on your band wagon than to put up with it until the project is done. The city granted a permit to build and access to the roadway was given but now it's in the best interests of the commuity to take away any and all rights you may have. Welcome to the new Montrose. All those affected should find a real good attorney and be prepared to take your case as far as it needs to go. To hold the city liable for not compensating those who's property rights and values have been affected. "

    " city planners are putting in " valley pans" to allow free flow of water to drain to the river, I dont think one of those 'planners', and I use that term loosely, took into consideration the 8' pipe lying below most of Main street and the finite amount of water it can carry, look for street flooding on main street in the near future. these guys are not planners, there soakers, and itsyou and me getting soaked. "

    " Why in the world would the city think they could make someones property unusable? Oh Yeah, eminent domain. You have just diminished the property value, may as well lower the property taxes, help the renters get lower rent. This is one of the most insane things I have heard the city doing in a long time. Are they following the DOT in making it hard to get into businesses along S Townsend? "
